General Terms and Conditions (GTC)

1. Provider

​

These General Terms and Conditions (hereinafter referred to as ‘GTC’) govern the use of the web-based software MarketNavigator (hereinafter referred to as ‘Software’).

2. Scope of application

​

These GTC apply to all contracts between the provider and the users of the software.

 

By registering, taking out a subscription or using the software, the user agrees to these GTC.

 

Any deviating terms and conditions of the user shall not apply.

3. Service description

​

MarketNavigator is web-based software for structured market analysis, decision-making and documentation of trading activities.

  • does not constitute investment advice

  • does not provide trading, buying or selling signals,

  • does not replace individual market or risk analysis.

The provider does not guarantee economic or financial success.

​

4. User Account

​

A personal user account is required to use the software.
The user undertakes:

  • to provide correct information,

  • to treat their access data confidentially,

  • to use the software exclusively for themselves.

The transfer of the user account or access data to third parties is prohibited.

​

5. Right of use

​

The provider grants the user a simple, non-transferable, time-limited right to use the software.
This right of use is limited to:

  • personal use,

  • the contractually agreed period,

  • the agreed purpose of use.

The following are expressly prohibited:

  • copying, reproducing or redistributing the software or source code, 

  • reverse engineering, decompiling or similar actions,

  • making it publicly available

  • commercial use outside the scope of the contract.

6. Subscription, term and automatic renewal

​

The software is used within the framework of a paid subscription (e.g. 3-month or annual subscription).

The subscription:

  • begins on the agreed start date,

  • is valid for the respective term booked,

  • is automatically renewed for the same term unless it is cancelled in good time.

​

Cancellation

​

Cancellation must be made at least 14 days before the end of the current term.
If cancellation is not made in due time, the subscription is automatically renewed.

​

7. Prices and payment processing

​

All prices are quoted in the specified currency and include statutory taxes, unless otherwise stated.

Payment processing is carried out by external payment service providers.
The provider does not store any payment data.

In the event of late payment or failed payment, the provider is entitled to block access to the software.

​

8. Contractual penalty for licence or copyright infringement

​

In the event of violations of these GTC – in particular unauthorised use, reproduction, distribution or publication of the software or source code – a contractual penalty of CHF 5,000 shall be payable.

The provider expressly reserves the right to claim higher proven damages.

The assertion of further legal claims remains unaffected.

9. Disclaimer

​

Use of the software is at your own risk.

The provider is not liable for:

  • Trading losses,

  • lost profits,

  • direct or indirect damages,

  • decisions made on the basis of the software.

The software is intended solely to support decision-making.

​

10. Availability

​

The provider endeavours to ensure high availability of the software, but does not guarantee uninterrupted use.

Maintenance work, technical faults or force majeure may lead to temporary restrictions.

​

11. Data protection

​

Personal data is processed in accordance with the provider's privacy policy, which forms an integral part of these terms and conditions.

​

12. Changes to the GTC

​

The provider reserves the right to change these GTC if this is necessary for legal, technical or operational reasons.

Users will be informed of any significant changes in an appropriate manner.

​

13. Applicable law and place of jurisdiction

​

Swiss law applies exclusively, excluding international private law

The place of jurisdiction is – to the extent permitted by law – the provider's registered office in Switzerland.

​

14. Severability clause

​

Should individual provisions of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
